ABSTRACT

The First General Assembly of the U. N unanimously affirmed both the Charter and Judgment condemning "Crimes against Peace". A war of aggression constitutes a crime against the peace for which there is responsibility under international law. The Tribunal considered the following acts as crime against peace, namely; "planning, preparation, initiation or waging of a war of aggression or a war in violation of international treaties, agreements or assurances or participation in a common plan or conspiracy for the accomplishment of any of the foregoing". Aggression is known to almost any scholar of law, let alone the judges sitting on the bench of International Criminal Court who according to the Rome Statute will hopefully be of the highest caliber in both international and criminal law from all major legal systems of the world. The President of the Preparatory Commission, Ambassador Philippe Kirsch was persuaded by the Arab Ambassadors during the July-August 1999 Session, to give more attention to aggression.
