ABSTRACT

The trend has been even more pronounced on digital services such as Netflix and Amazon, which have demonstrated a willingness to pay top dollar to lure talent to their platforms. In addition, studios often require writer/producers to agree to render services exclusively in the medium of television for the life of the agreement, even outside of active series writing and production periods. At the development/pilot stage, there is seldom any such thing as a writing deal by itself—nearly every agreement for the writing or acquisition of a pilot script include negotiated terms for the writer's ongoing participation in the production of the series as a producer. Most deals for producing services by a writer/creator cover a pilot and two seasons of production. Consequently, unlike writer/producers, non-writing producers virtually always seek to be locked for the life of a series. Non-writing producers who are not locked for the life of a series may also be entitled to a "consulting one-for-one".
