ABSTRACT

This chapter examines the process of judicial appointments in Bangladesh. The next section sets out the position of the Supreme Court in the Bangladesh Constitution and the manner of appointment of the Chief Justice and other Judges of the Supreme Court of Bangladesh. Critique of the judicial appointments process contains a critique of the process of appointing the Chief Justice and other Judges of the Supreme Court of Bangladesh with specific reference to the collegium system of judicial appointments in India. 'Towards fairness and transparency in judicial appointments' considers the possibility of constituting an independent judicial appointments commission to recommend judicial appointments. The chapter explains the Judicial Appointments Commissions in the United Kingdom and South Africa and the attempt to set up a National Judicial Appointments Commission in India. It concludes by emphasising the importance of the courage and integrity of the individual Judge in upholding the independence of the Judiciary and enforcing the rule of law.
