ABSTRACT

This chapter discusses the potential factors that affect the rule of law in developing countries like Bangladesh and have an impact on the judiciary. It deals more specifically with the rule of law in Bangladesh. The chapter also discusses together the role of the Constitution in regard to the rule of law with how the different legislations passed in the parliament affects the lives of the citizens. The current scenario shows that in fact politicians can easily undermine the rule of law instruments, subvert democracy and alter the different conditions of the competition with strategies that use the independence of the judges. The executive or the politicians may use the rule of law against democracy if there is political instability under democracy. The rule of law is possible where power is dispersed and embedded in multiple institutions. The chapter also presents an overview of the key concepts discussed in this book.
