ABSTRACT

Fairness depends critically upon the determination of claims. Strict fairness is a matter of claim proportionality and is thus a matter of equality of a certain sort, namely equal in terms of units of allocation per unit of claims. Fairness in the sense of claim-proportionality is critically dependent upon the nature and variety of the relevant claims. Fairness, then, is a matter of how people fare in relation to one another in point of the comparative treatment of their claims. Theorists who have a special fondness for lotteries and similar modes of random allocation have had a good deal of difficulty with the idea of satisfaction of claims, rights, and deserts.
