ABSTRACT

Thelinesofthecomplaintandthelinesofitsdiscussionboth seemtomeextremelyinteresting.ApartfromErieR.R.Co.v. Tompkins/thecomplaintranalongtwoprimarylines:fir?t,and especiallyintaxcases,theSupremeCourthasrecentlyshifted ground,withanoticeabletrendtowardwideningtheavailable linesoftaxation.Second,theSupremeCourthasopenlyexpressed theideathatwhereolderdecisionshavebeenmistaken,theycan dowithre-examination.Fromsuchobservationsthesomewhat amazingconclusionwasdrawnthattheSupremeCourt,and constitutionalcasesinparticular,aresufferingfromaserious shakingorunderminingofthedoctrineofprecedent.
