ABSTRACT

Takao Tanase is a Japanese distinctive legal scholar characterized by a striking personality with an easy manner of "pursuing innovation academically rather than fame and interests". Famous for his pioneering theory of resolving disputes and judicial procedures, he has dedicated himself to an extensive expanse of practical research. Procedural analysis considers litigation as a procedure, an interactive procedure among participants. Takao Tanase once asserted that the methodology of procedural analysis should take the induction of "what is", instead of the deduction, "what should be", as its starting point. A meeting of minds refers to the principled willingness of seeking common ground while reserving differences instead of being hypocritical. A meeting of minds can only take shape and continue to exist in cases where there is a wide meeting of minds of opinions shared in the relationship between basic social values and the institutional tools for realizing them.
