ABSTRACT

Adam Smith, who first put forward the theory of the market economy, proposed that due to the "invisible hand" of markets, the individual pursuit of interest would lead to a balance of supply and demand, as well as improve the efficiency of resource distribution. There was a need for a legal service, which was the prerequisite for lawyers in theory. This was at a time when the state allowed other sanctions to be replaced with a payment currency and the monetary economy was developed, when the law had some room for operation, instead of excluding discretion, when the trial procedure allowed both plaintiff and defendant to debate, and the relationship between rights and obligations was complicated. State intervention is a very convenient and feasible way to solve problems regarding the strengthening of public service and avoiding the disadvantages of legal commercialism.
