ABSTRACT

Legal/technical is probably one of the most complex areas of the TDD or commercial building survey process and it does not conform to the principle that the surveyor can say what they see. In essence, this relates to aspects of the building or its operation that have a legal obligation with a technical application. This is where there is a professional interface between the legal due diligence and technical due diligence and, invariably, the matters identified or discussed are potential deal-breakers. The answers or solutions to issues raised are not always straightforward and the surveyor must still deliver evidence-based recommendations, resisting any pressure applied by the agent, client and legal advisors to verify conformities when often all of the information is not available.
