ABSTRACT

The duty imposed by law on management to provide a safe environment for its fans is long-standing. Although what actually constitutes a safe environment may vary from sport to sport, the traditional rules of negligence law have long been applied to sports venues. Traditionally, fan misbehavior has been seen in terms of criminal conduct: fights among fans, trespass onto the field of play, offensive heckling. Incidents of fan-on-fan violence have led management to provide security personnel in larger numbers and greater presence, including screening upon venue entry and video surveillance of the venue and parking facilities. The prevalence of fan codes of conduct is illustrative of the significance of fan ethics in modern athletics. Fan conduct is circumscribed at all levels of competition and with varying limits.
