ABSTRACT

In sports, the primary legal prescription regarding gender started with some important legislation in 1972. The history of the development of the ethics of this situation, therefore, largely tracks the legislative and judicial development of that legislation. There has been discrimination against women in sports since ancient times, when they were not allowed to participate in the Olympic Games. The discrimination continued unabated until the passage by the US Congress of Title IX of the Education Amendments of 1972. The ethics of treating like cases alike, a version of universalizability has been reflected in Title IX to dramatic effect, greatly increasing the participation of women in sports. Title IX continues to develop, with recent cases in the area of sexual orientation and transgender rights. The importance of Title IX is such that anyone connected with sports should be knowledgeable regarding the law, the regulations, and ethics related to it.
