ABSTRACT

The police officer will then ask the suspect if he or she wishes to comment on what the arresting person has said. The police officer will then caution the detained person stating that they do not have to say anything, but that it may harm their defence if they do not mention when questioned something which they later rely on in court, and that anything they do say may be given in evidence. If the evidence presented to the police officer is considered to present a prima facie case against the detained person, the police officer may arrest that person to be detained at a police station.
