ABSTRACT

The Internet’s greatest aĴraction is that it is an open environment. One area which offers huge opportunity for a music business is the increasingly sophisticated means by which personal information about the consumer can be obtained. The richness of the content of this data and how it may be measured is simply incredible and was not possible only a few years ago. To ensure the success of many online music applications, whether it is the offer of physical music CDs and other merchandise over the Internet, or the making available of online music downloads, it is important the company can target its users properly. However, the Internet does not exist in a legal vacuum. In the EU, at least, it resides in a heavily regulated data protection regime. In this chapter we will examine why privacy laws have huge significance in relation to the Internet and mobile telephone use by music companies.
