ABSTRACT

The ontological LAH presents a radical new conceptualization o f law as art. LAW is differentiated as a kind of art by the LCATH,, and I now propose to take LCATH, and refine it as a working hypothesis, by testing the metaphorical ‘fit’ o f OMD2, (as a heuristic), by using it to explain my experience of legal reality. I have already said that the basis for selecting OMD2 as a metaphorical heuristic for LAW, is that it is coherent with the five basic facts about ‘law’ derived from personal legal experience; five primary facts for which any putative theory of law must account. The test for the correctness of this preliminary claim to ‘fit’, given the SRH, will be the explanatory power of the hypothetical model constructed.
