ABSTRACT

This chapter sets out some postmodern analysis to highlight that feminists need to retain normative foundations of human subjectivity if they are to coherently produce better ways of being for humans. The analysis therefore queries certain postmodern theories of the subject or self which have anti-normative views of the subject with regard to analysis of the human on which to build feminist freedom. Postmodern relations of power render claims of truth or falsehood illegitimate and aim to displace the unified category of "woman" as a subject. The chapter analyses the use that can be made of deconstructive method for feminist legal theorists. Many feminist theorists have sought to use postmodernism, perceiving its methods to be useful in being wary of generalisations that transcend the boundaries of culture and region. Certain prominent feminists use postmodern or poststructural method in their theories. Some feminist work has sought to use postmodern method and while dismissing normativity, seems to be driven by normative beliefs.
