ABSTRACT
Differential treatment is today a common feature in international environmental law. While there are sound conceptual grounds for granting differential treatment in international environmental law, it is still debated whether differentiation could be used more systematically and in other areas of international law. Given the paucity of studies examining the conceptual bases of differential treatment, this chapter provides an overview of some general theoretical issues concerning differentiation.
