ABSTRACT

Giving evidence is a great example of the saying 'What goes round, comes round' and the employers just have to accept it is their turn in the barrel. If they have done their job professionally and fairly, the pain about to be inflicted on them will be unpleasant but tolerable. The big problem comes with cross-examination by opposing counsel and, if there are a lot of defendants, each one will have a personal monster that will attack the employer. At the close of the prosecution case, evidence will be called for the defence, including witnesses, experts, other defendants and even the malodorous villain himself may be brazen enough to take the stand. Eventually, at the close of the defence case and submissions, the judge will sum up the evidence and this will reveal just how clever he really is.
