ABSTRACT

This chapter describes each of contentious areas of discrimination law in turn. It examines that there have been significant developments in recent decades, gives women legal rights to equal pay and to maternity and parental leave, and provides some protection from sexual harassment. The chapter shows that while maternity-specific provisions are part of the answer, another part may be parental leave rules which allow caring responsibilities to be shared between parents regardless of sex after the child is born. It discusses here in relation to transgender and sexuality. The chapter explains that much of the impetus for equality law has come from the European Union. It describes what legal remedies are available for sexual harassment at work. The law has long regulated the workplace primarily as a site of economic activity. That aspect of employment is of course critical. For women, their economic dependence upon men is a source of subordination.
