ABSTRACT

The purpose of this paper is to examine both US and international controls on the export of hazardous substances. In the first section, the discussion begins with a review of the restrictions on exports embodied in US law, and examines controls placed on the export of consumer products, pesticides, toxic substances and exports subject to the Export Administration Act. The second section follows with an analysis of three proposed amendments being considered by the Congress at this writing to: the Export Administration Act that would establish a statutory policy on hazardous exports, the Resource Conservation and Recovery Act regarding the export of hazardous wastes, and the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) which would further regulate pesticide exports.
