ABSTRACT
In Chapter 12 we examined how “things” are introduced into evidence. In this chapter we will look at the issue of materials used to help the decision maker better understand an issue, but which are not introduced into evidence. Like the law on introducing “things” into evidence, there are no provisions in FRE regarding this issue; it is all common law found in court decisions.
