ABSTRACT

Unlike judicial notice, Rule 803(17) relates merely to admissibility, not weight. Under judicial notice the matter is taken to be conclusively established as true, whereas here the matter is merely admitted into evidence for consideration by the fact finder, be it judge or jury. Examples of printed materials of this type include real estate sales in a given area compiled by a multiple listing agency, stock market reports in the newspaper, the Physician’s Desk Reference, and engineering handbooks. The witness must only say “This is a source that I regard as accurate and normally rely upon in my work,” and the publication becomes admissible.
