ABSTRACT

The rules of civil procedure govern trial preparation and conduct in the courts. The standard rules of civil procedure are those used in the Federal courts, the Federal Rules of Civil Procedure (FRCP). FRCP was adopted by the Supreme Court in 1938, and most states now follow the same general principles in civil procedure as do the Federal courts. The basic principle of FRCP is “notice pleading,” which means that the papers filed in the courts do not require a great amount of detailed factual information but merely enough information to “put the opposing party on notice” of the issues to be contested at trial.
