ABSTRACT

After the detention hearing and before the jurisdiction hearing, the DA can ask for a waiver or transfer hearing to decide if the juvenile should be in juvenile justice court. The DA normally does this because the charge is very serious and the juvenile is old enough to be tried as an adult. The probation officer investigates and provides the court with a report about how the juvenile acts and his or her social history. The judge looks at this to decide if the juvenile would do well with the care, treatment, and programs in the juvenile justice system. The probation officer recommends to the court whether or not they think the juvenile should be tried as an adult.
