ABSTRACT

There are two types of secret trusts, fully secret and half-secret trusts. Fully secret trusts arise where the existence of the trust as well as its terms are fully concealed on the face of the will, but the testator has communicated the terms of the trust to the trustees during his lifetime. A half-secret trust arises where the will acknowledges the existence of the trust but the terms are concealed on the face of the will, provided that the terms of the trust are communicated before or at the time of the execution of the will.
