ABSTRACT

AIMS AND OB ECTIVES This chapter examines the different contexts in which the right to life has to be considered and aims to do the following:

• Identify the main Convention provisions that apply

• Examine Art 2 of the ECHR and the defences

• Consider UK domestic and European case law

• Examine the requirements for investigation of mistakes

• Explore deaths that occur as a result of war

• Examine the implications that arise when deaths occur whilst the deceased is in custody

• Consider the parameters of the right to life and whether there is a right to die

• Examine self-defence and its impact on Art 2.
