ABSTRACT
In 1942 the GOC Burma ordered destruction of the appellant’s oil installations to prevent seizure by invading Japanese forces for whom they would have had great strategic value. Burmah Oil sued the British Government for compensation, the defence being that the order was an exercise of the royal prerogative and therefore legal under common law.
