J an intentional infliction of harm – which is negatived by consent, for example where a patient signs a consent form in respect of an operation there is no battery, and
J a negligent infliction of harm – in which for the defendant to avoid liability for his otherwise negligent act the claimant must voluntarily accept the risk of injury.
