ABSTRACT
This chapter will seek to address the various types of federal intellectual property protection that are available for plants and plant materials. While some forms of state intellectual property rights exist, a discussion of these rights is beyond the scope of this chapter. Additionally, this chapter is not intended to be an exhaustive discussion of the various forms of intellectual property protection available for plants and is not to be construed as a legal advice regarding any form of intellectual property discussed herein. Readers are strongly encouraged to seek legal counsel for advice relevant to any intellectual property issue encountered.
