ABSTRACT

Occupational Safety and Health Administration (OSHA) was formed by the Occupational Safety and Health Act (OSHAct) of 1970. Congress gave OSHA a mandate to develop regulations and standards to protect the American worker. Not only was OSHA to develop these regulations, but also was to implement (promulgate) them and enforce them to protect a valuable entity (the American worker). OSHA has no choice but to follow the mandate provided by Congress. Over the years, OSHA has gone from a strict enforcement agency to an agency bent on trying to help employers comply with its regulations.
