ABSTRACT

Almost all researchers in the field of dispute

resolution agree that disputes are inevitable and

may become destructive in the construction

projects. Ellis & Baiden (2008) state that disputes

between project participants have been identified

as the principal causes of poor performance in

construction projects and that disputes very often

lead to prolonged delays in implementation, inter-

ruptions and sometimes suspensions. This poses a

serious risk for all parties to a construction project

if the disputes are not resolved before going to a

court since litigation is a long, expensive and acri-

monious process.
