ABSTRACT
The magistrates have a discretion to allow a defendant to change his plea from guilty to not guilty at any stage before sentence is passed (S (an Infant) v Recorder of Manchester [1971] AC 481; [1969] 3 All ER 1230). The question for the magistrates is whether the original plea was unequivocal and entered with a proper understanding of what the charge entailed.
