ABSTRACT
The Secretary of State carries out a quasi-judicial function in relation to the operation of planning legislation since he deals with the planning merits of cases and also the law relating to planning (see Chapter 2). The courts are responsible for ensuring that the Secretary of State does not abuse or misuse the powers granted to him by statute, and that includes the methods adopted in determining issues which are brought before him or before inspectors making decisions in his name.
