ABSTRACT

The PCN was introduced by ss 171C and 171D and allows local planning authorities to serve the notice whenever it appears to the authority that there may have been a breach of planning control in its area, that is, carrying out development without the required planning permission, or failing to comply with any condition or limitation attached to a planning consent (s 171A(1)). The notice is served on the owner or occupier of land, or any person who has an interest in it, and may also be served on any person carrying out operations on the land or using it for any purpose (s 171C(1)).
