The need for precise interpretation of these sections has resulted in numerous appeals to the courts to determine the meaning of ‘fixed’ and ‘curtilage’. Perhaps fortunately, there does not appear to have been a challenge on the issue of what is ‘man-made’! The principle is that every part of a listed building is, in law, equally listed, not merely the exterior. All the features in the interior which are regarded in law as ‘fixed’ are included in the listing, irrespective of whether or not they were added later and are attractive or unattractive elements, or may even be considered to detract from the character of the interior.
