ABSTRACT

The general rule is that the writ of summons and other documents relating to the action must be served personally.39 If the other party refuses to accept it, the document must be left as close as possible to them.40 This common law rule is specifically endorsed by inclusion in the Tongan Rules.41 Under the Fiji Rules, although the normal rule is personal service,42 service of the writ by post or hand delivery is allowed.43
