ABSTRACT

After the close of pleadings, a party may seek to further limit the issues at trial by issuing such a notice, which seeks an express admission from the other party of matters wholly or partly adverse to their case.57 A party may also issue a notice to admit documents.58 This requires the other party to admit the authenticity of a document so that it does not need to be formally proved at trial. The Fiji Rules provide for automatic admissions in some cases.59 Where an admission is clear and disposes of the whole or part of an issue in the action, application may be made for judgment.60 Application may be made on the basis of formal or informal admissions.61
