This is a prosecutor’s appeal by case stated from the decision of Mr Recorder Clifton sitting at the Crown Court at Bolton on 25 May 1991. The Recorder allowed the appeal of the respondent against a conviction on 4 December 1990 by justices sitting at the Bolton Magistrates’ Court.
