ABSTRACT
Initially, these Regulations only applied to any new workplace, or new part of a workplace, but, from 1 January 1996, they were made applicable to all workplaces. The Regulations created civil liability. Civil liability can only arise when it can be established that Parliament intended that the breach of any statutory duty should be actionable by any person(s) harmed by the breach of that duty.
