ABSTRACT
Introduction Nuisance refers to two torts: public nuisance and private nuisance. Private nuisance is primarily concerned with conflict of rights relating to uses of land, whereas public nuisance is concerned with protecting rights of the public at large. The same incident may give rise to both a public nuisance and a private nuisance (see, for example, Halsey v Esso Petroleum Co Ltd (1961)).
