ABSTRACT

On divorce, the courts have wide powers to order ancillary relief for the parties to the marriage. This can take the form of secured or unsecured periodical payments, lump sum orders (s 23 MCA 1973), and property orders (s 24 MCA 1973). In deciding what kind of order to make, the court will have regard to all the circumstances of the case, and the factors mentioned in s 25 MCA. In the instant case, the parties have reached agreement on certain matters, which will be taken into account when advising Robert as to his potential liability.
