ABSTRACT
The inappropriate use of experts to bolster cases leads to additional cost and delay. It arises and is allowed to continue because parties at present have complete control over the scope and management and presentation of their case. There is no pressure to narrow issues or to eliminate peripheral issues, and the current arrangements for costs provide insufficient or ineffectual sanctions against such excessive or inappropriate tactics.
