Modes of appointment An executor is a person who carries out the terms of a will. Appointing executors is a testator’s prerogative. Such appointments are usually made in the will or a codicil. Occasionally, an executor may also be appointed either by:
• some other person authorised to do so by the testator; or • the court acting in the exercise of its statutory powers.
