ABSTRACT

The general responsibility for regulating competition in New Zealand falls on the Commerce Commission, established in 1986 by virtue of s 8 of the Commerce Act 1986 (‘the Act’), although the arrangements for air transport differ depending on whether it is domestic or international air transport. In addition to its responsibilities under the Act, the Commerce Commission is also responsible for enforcing the Fair Trading Act 1986 on the protection of consumer rights and competition. It is, however, the principal competition provisions of the Act which are of interest for present purposes.
