Copyright may subsist in the instructions and in the art work on the packet of Whoosh! The instructions on the packet of slimming powder are a literary work under s 1(1) of the CDPA 1988. In Exxon Corporation v Exxon Insurance (1982), it was held that a literary work is one that conveys information or instruction. Copyright exists in the expression of the words, not the information itself.
