ABSTRACT
Where loss is caused by competing factors, Art 17(5) provides that the carrier ‘shall only be liable to the extent that those factors for which he is liable under this article have contributed to the loss, damage or delay.’ The basis of such apportionment may either be related to the contribution of each cause to the loss, or be based on the degree of fault of each party.
