ABSTRACT

On 19 October 1991, ss 2 and 3 of the Children Act 1989 changed the status of parents in relation to their children, creating the concept of ‘parental responsibility’.

Parental responsibility may be shared with others and it may be delegated in part, but it may not be surrendered or transferred entirely save by adoption. Each person who has parental responsibility may exercise it without a duty to consult others who also have it, with certain exceptions, but, for example, in the event of disagreement or a need for child protection, its exercise is also subject to orders of the court.
