ABSTRACT

A further complication arises from the fact that a decision of the European Court of Human Rights may lead to a change in the law by legislation. This is especially likely in England in view of the very limited effect of European human rights law there on its own. This may mean that the legal position which forms the basis of an application to the European Court of Human Rights no longer represents the law in the country from which the case came.11 The case may however still be an important part of European human rights law because of the principle which it establishes.
