ABSTRACT

There are a number of different orders about costs the court will commonly make when dealing with the case before trial. In relation to an application or hearing, these range from an order that a particular party is to bear the costs of the application or hearing whatever the outcome of a case, that the party who is successful at trial will be entitled to the costs of it, or that neither party will be entitled to the costs of it, depending on the nature and outcome of the application or hearing.20
