ABSTRACT

Under the old rules, there were differences in the methods of service permissible for service of originating process (the collective name for the documents that could be used to start proceedings) and those permissible for all other types of document. The rules restricted the methods available for originating process but allowed a greater variety of methods for other documents such as pleadings, including such means as document exchange and fax. Further, there were differences in practice between the two courts in that the Rules of the Supreme Court made no provision for proceedings issued in the High Court to be served by the court, whereas in the county court, service of proceedings issued by the court was the usual mode.
