ABSTRACT
Depending on whether the case is proceeding in the High Court or a county court, the defendant’s home court is defined as either the county court for the district in which the defendant resides or carries on business, or the district registry for the district in which the defendant resides or carries on business, or if there is no district registry, the Royal Courts of Justice (r 2.3). It should be noted that the reference is to the home court of the defendant personally and does not include the defendant’s solicitor’s home court – that provision was recently removed (2 October 2000), as the solicitor’s address was often some distance from that of the client.
